TN Supreme Court and 6th Circuit Court of Appeals Affirm Summary Dismissals Favoring Peterson White Clients – Peterson White, LL

Peterson White attorneys Nick Peterson and Ryan Malone received favorable rulings this week from the Tennessee Supreme Court and 6th Circuit Court of Appeals upholding the summary dismissal of two cases.

In the first case, the pair represented a large retailer in federal court. The plaintiff alleged that she fell in an oil patch the store had negligently caused or failed to prevent. Nick and Ryan argued that the plaintiff’s fault exceeded any fault attributable to the store, precluding her recovery, and both the district and appellate courts agreed.

In the second case, Nick and Ryan obtained summary judgment for an employer in a workers’ compensation claim on the basis that the employee failed to provide sufficient medical proof of causation. The employee appealed, but the Bureau of Workers’ Compensation’s Appeals Board affirmed the dismissal. The employee then sought to appeal to the Tennessee Supreme Court, but the state’s highest court dismissed the appeal on jurisdictional grounds.
